We have taken all care and precaution to try and provide accurate data and information. In the preparation of the content of this Website, in particular to ensure that prices quoted are correct at the time of publishing and all products have been fairly described. All prices are displayed inclusive of all applicable taxes. Packaging may vary from that shown. The weights and dimensions given are approximate only. We have made every effort to display as accurately as possible the colours of our products that appear on the Website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will accurately reflect the colour of the product on delivery. In that case, your order for purchase constitutes your offer which shall be subject to the terms and conditions of this User Agreement. Dispatch of all the product(s) ordered, may or may not happen at the same time, in such a scenario that portion of the order which has been dispatched will be deemed to have been accepted by us and the balance would continue to be on order to us and we reserve the right to accept or reject such balance order.

Pnut.fit Pvt. Ltd. holds all rights in relation to www.pnut.co.in. Any payment made to www.pnut.co.in will be on behalf of Pnut.fit Pvt. Ltd.. We would like to declare that Pnut.fit Pvt. Ltd. is the legal and business face of www.pnut.co.in and will act as one if there are any issues. You are advised to regularly check for any amendments or updates to the terms and conditions from time to time. Pnut.fit Pvt. Ltd. reserves the right to add or change or update these Terms and Conditions, from time to time entirely at its own discretion. You are responsible for checking these Terms and Conditions periodically to remain in compliance with these terms. Your use of this site after any amendment to the Terms and Conditions shall constitute your acceptance of these terms and you also agree to be bound by any such changes/revisions. Any clause of Terms and Conditions if deemed invalid, void or for any reason unenforceable, shall be deemed severable and shall not affect the validity and enforceability of the remaining clauses of the terms and conditions. If you do not approve of the terms and conditions of pnut.fit Pvt. Ltd. you are free to leave this website. By continuing to use this website you are agreeing to the terms and condition of this website. Pnut.fit Pvt. Ltd. besides itself operates under four sub-brands namely “Plant Vegan Kitchen”, “The Keto Kitchen”, “Salad brigade” and “Fitbox”. Hence, orders placed for products listed under any of these brands/sub-brands shall be governed by the Terms and Conditions of this User Agreement. Products and services displayed on the website may not always constitute an offer to sell. Orders placed by you are offers to purchase particular product under the terms and conditions in this agreement at the price specified (including delivery and other charges). We reserve the right to accept or reject your offer for any reason (or no reason) including, but not limited to, the unavailability of any product, an error in the price or product description, or an error in your order. In the event that we cancel your order, we will provide a full refund of any payment received. We will not be able to cancel orders that have already been processed, it is pertinent to note that the pnut.fit Pvt. Ltd. has the full right to decide whether an order has been processed or not. User hereby agrees and undertakes that the decision taken by the pnut.fit Pvt. Ltd. is acceptable to User and User shall not create any dispute on the decision taken by pnut.fit Pvt. Ltd. on cancellation.

We will only dispatch your product when we can confirm that the payment is received in full. In case a payment is declined either by your bank, credit/debit card we won’t be able to dispatch the product. Any order placed for a product that is listed at an incorrect price may be cancelled. This shall be regardless of whether the order has been confirmed and/or payment levied. In the event the payment has been processed, the same shall be credited to your account and duly notified to you by email.
Any information obtained by Pnut.fit Pvt. Ltd. will only be used for the sole purpose of this website. We assure you that this information won’t be provided to other companies and held with us as Confidential. Customers also agree to receive promotional messages via Email, SMS or any other medium. You agree not to access (or attempt to access) any part of the Website by any means other than through the interface provided by us.
We reserve the discretion to change and alter the look and feel of the website. We do not need to inform you of these changes. We hold complete rights to suspend/put on hold/stop your account. By doing so, you may not be able to access this website. We will not be liable to you or any other party when doing so. When registering to become a member and activate an account, you must provide information like your name and address, and a valid email address. You agree to provide accurate and complete information and to keep this information current. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.
If you suspect or become aware of any unauthorized use of your account or that your password is no longer secure, you agree to notify us immediately.
In case of an event/competition/contest/draw the winner is required to produce a valid form of photo identification. Failure to provide us the ID could lead to the winner being disqualified from the competition.

Eligibility to use

Use of the Website is available only to persons who can form legally binding contracts under applicable law. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including un-discharged insolvents etc. are not eligible to use the Website. We reserve the right to terminate your membership and refuse to provide you with access to the Website at our sole discretion. The Website is not available to persons whose membership has been suspended or terminated by us for any reason whatsoever. If you are registering as a business entity, you represent that you have the authority to bind the entity to this User Agreement. We make no representation that any products or services referred to in the materials on this Website are appropriate for use, or available outside India. Those who choose to access this Website from outside India are responsible for compliance with local laws if and to the extent local laws are applicable. We will deliver the products only within India and will not be liable for any claims relating to any products ordered from outside India. Some Indian states prohibit direct sale of merchandise from other states and require special documentation to effect such a sale without dual taxation, if we receive an order from such states or to be delivered to such states under such circumstances we retain the right to accept or reject the order at our sole discretion. Those who choose to access this Website from Indian states which restrict such use are responsible for compliance with local laws if and to the extent local state laws are applicable. We will deliver the products only within states having open import policy and will not be liable for any claims relating to any products ordered from restricted states. Except where additional terms and conditions are provided which are product specific, these terms and conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with any other terms of any order submitted.

Usage Restrictions

Quantity Restrictions

We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit / debit card, and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should such limits be applied. We also reserve the right, at our sole discretion, to prohibit sales to any one as we may deem fit.

Pricing Information

While we strive to provide accurate product and pricing information, pricing or typographical errors may occur. We cannot confirm the price of a product until after you order. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we shall have the right, at our sole discretion, to refuse or cancel any orders placed for that product, unless the product has already been dispatched. In the event that an item is mis-priced, we may, at our sole discretion, either contact you for instructions or cancel your order and notify you of such cancellation. Unless the product ordered by you has been dispatched, your offer will not be deemed accepted and we will have the right to modify the price of the product and contact you for further instructions using the e-mail address or the contact number provided by you during the time of registration, or cancel the order and notify you of such cancellation. In the event we accept your order the same shall be debited to your credit / debit card account and duly notified to you by email or the contact number, as the case may be, that the payment has been processed. The payment may be processed prior to dispatch of the product that you have ordered. If we have to cancel the order after we have processed the payment, the said amount will be reversed back to your credit / debit card account. We strive to provide you with best value, however prices and availability are subject to change without notice. Our promotional offers/discounts are not sitewide and are limited to selected categories. Coupon codes also may not be applicable on all categories. or such other product or service.

Payment

All payments must be received by us prior to shipping unless the order is placed by using Cash on delivery (COD) payment mode. We accept payment by cheque/cash/draft, net-banking, credit card, debit card, cash card, mobile payments. In a case of a Credit Card/Debit Card you must use the card in your name. www.pnut.co.in holds no responsibility for a fraud or a transaction that can be deemed illegitimate.

Handling and Delivery

We will arrange for delivery/shipment of the products to you. We would try to deliver the products in the mentioned time however we realize that there could be circumstance where we would be unable to meet our time frames. Delivery/Shipping schedules are estimated only and cannot be guaranteed. We are not liable for any delays in the delivery via third party delivery parties in case of product ordered via other food delivery portals which pnut.fit is listed with. If you fail to accept delivery of Food Delivery and/or Goods at the time they are ready for delivery, or we are unable to deliver at the nominated time due to your failure to provide appropriate instructions, or authorizations, then such goods shall be deemed to have been delivered to you and all risk and responsibility in relation to such goods shall pass to you. You must ensure that at the time of delivery of Food Delivery and/or Goods adequate arrangements, including access where necessary, are in place for the safe delivery of such goods. We cannot be held liable for any damage, cost or expense incurred to such goods or premises where this arises as a result of a failure to provide adequate access or arrangements for delivery. Any storage, insurance and other costs which we incur as a result of the inability to deliver shall be your responsibility and you shall indemnify us in full for such cost. Once your food has been delivered to your nominated address, Pnut takes no responsibility for items that spoil due to temperature, are stolen, lost or damaged by external factors. Refunds or replacement of food will not be issued under these circumstances. Hence, risk of loss and damages pass on to you upon the products delivered to you. In order to avoid spoilage, the meals are prepared via smart cooking techniques and despatched within a time period as expedient as possible. However, in cases where the product has been ordered via third party food delivery services, Pnut.fit shall not be liable for any spoilages. In order to maintain the nutrition level of certain food products, customers may receive food at chilled or at room temperature also. It is recommended that in order to enjoy meals, customers re-heat the food (except salads and sandwiches) before consumption. Pnut.fit accepts no responsibility for foods that are not stored, reheated, or eaten according to our instructions prior to consumption.

In case of the “Ketokit”, it is strictly advised that the same may be stored under normal refrigeration i.e. 0 to 4 degree Celsius. Besides, every “Ketokit” also comprises of an instruction flyer affixed inside the box. For the moment, the “Ketokit” can only be ordered through the official website of Pnut.fit. However, certain ala-carte items/products from the “ketokit” that can be stored at room temperature are listed and available for ordering via third food delivery vendors. Pnut.fit takes no guarantees of delivery time in instances such as strikes, bandhs, riots among others. Any loss or delay due to such instances are unavoidable and will be dealt as part of business.

Changes and Cancellation

Any item additions, quantity changes or specification changes made to accepted orders will be modified in the order details. All sales are final, provided, however, item cancellations and quantity reductions may be made before the order is despatched. We may, without liability, cancel any accepted order before shipment if our credit department does not approve your credit or if there are other problems with the payment mode selected by you.

Refund

Pnut.fit shall does not offer any refund except in cases where the customer has subscribed to meal plan(s) and wishes to abort the same provided the same is communicated to us either via email or telephonically only within 5 days from the commencement of such plan. In the case mentioned above, the refund shall be offered with a deduction of Rs. 5000/- or 5% of the total subscription cost whichever is more.

Besides, in cases of personal emergencies you can cancel up to two day’s meals, which would be subsequently added to the coming week in the respective manner. All the plans need to be consumed within their respective periods, post which the plan would automatically lapse.

As regards the “Ketokit”, Pnut.fit does not entertain any refund except in cases where such product has been delivered in a defective condition OR the order has been cancelled within 5 minutes of placing such order. The refund in the first scenario shall be offered to the customer’s account with Pnut.fit only via credit points equivalent to the value of such order. In the second scenario Pnut.fit shall offer a refund of the entire amount via same mode as such order had been paid for.

Your Account

Protection of Your Account: As discussed further in the website’s privacy policy, by using this website, you agree that you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and agree to accept responsibility for all activities that occur under your account or password.

Use by Children: By shopping on this website you confirm that you are above the age of 18 and agree to the Terms and Conditions. We hold the rights to take legal action against any losses we incur as a result of minor ordering on our website without the consent of their guardian/parent. As discussed further in the website Privacy Policy, products ordered on www.pnut.co.in for children are mandatorily to be ordered by adults. If you are under age of 18 years, you may use www.pnut.co.in only with involvement of a parent or guardian. www.pnut.co.in and its affiliates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
